How do I apply for a visa for an employee?

To hire a foreign citizen as a temporary worker, you need to file a nonimmigrant petition on behalf of the prospective employee with the U.S. Citizenship and Immigration Services (USCIS). The employee must meet the specific qualifications of the position you are trying to fill.

Many workers come to the United States on an H-1B visa. To bring an employee to this country using an H-1B visa, the position must be in a “specialty occupation” that requires a certain level of education or training.  An H-1B visa allows the employee to remain in the United States for three years, which can possibly be extended for an additional three years.
